These are the terms of use and sale (the “terms) for your use of the sites owned by Divinus Shefa Corp., including but not limited to www.beautyscout.com (the “Site”).

By visiting our site and or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, customers, and merchants. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Registration

You will need to register an account to use some of the services available to you on the Site. In registering an account, you agree to provide information about yourself that is true, accurate, current, and complete in all respects. You must also keep your information up-to-date by informing us of any changes by using the relevant sections of the site. To place an order with us, you must be at least 18 years old and legally eligible to enter into binding contracts. If you are under 18 years of age, you may only place an order with the consent of your parent or guardian.

Beautyscout.com reserves the right to take actions against your account for activities, including, but not limited to:

1. Using other devices to attempt to hide the use of multiple accounts or disrupt any of our services;
2. Committing or encouraging a criminal offense
3. Transmitting or distributing a virus, including, but not limited to, trojan horses, trap doors, back doors, easter eggs, worms, time bombs, or computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or personal information;

Shopping

Beauty Scout operate on a first-come, first-served basis policy. Therefore, items in stock may currently appear on your Cart but can be purchased by another customer who was first able to complete the check-out and payment procedures. However, any stock from cancelled orders go back to the Site the next day and may be purchased by you or any other customer subject to the completion of our check-out and payment procedures.

BeautyScout may, in its sole discretion, choose to accept or decline your order for any reason. This may happen, for example, when the item you wish to purchase is out of stock or has been damaged; we suspect the request is fraudulent or in any other circumstance BeautyScout deems appropriate.

BeautyScout will not charge you for orders that were not processed or canceled prior to shipping.

Beauty Scout endeavors to take extra measures to provide you with accurate information on products we offer on the web site. However, it does not guarantee that the information is error-free, current, complete or reliable.

Inventory levels fluctuate. In such instance, you may have been able to place an order online for a product portrayed as having stock, but once we attempt to process find out that the product is sold out. In cases like these, we will notify you immediately via email.

Pricing

All prices posted are inclusive of Value Added Tax (VAT). Delivery charges will be indicated in the Checkout page. All charges are stated in Philippine Peso. We cannot, however warrant against pricing error. If you have placed an order for a product whose price posted was incorrect, said order will not be process.  In this case, you will be immediately notified via email.

Shipping

Upon successful order you will be given an indication of the expected delivery time when you place your order online. BeautyScout will try its best to meet these estimates but cannot guarantee that such estimates will be met.

Our delivery schedule is 2-5 days in NCR, 6-8 days in Luzon and 8-10 days in Visayas and Mindanao after payment is received, or if COD, after order is received. Delivery schedule excludes Sundays and holidays. Delivery areas are limited to the following and locations in extremely remote or inaccessible areas such as mountain locations, or those that will require limited sea/air travel:

Upon delivery you need to sign a confirmation of receipt of the products when the products are collected and by doing so, you accept the responsibility for the products ordered from that moment on. If the recipient or collector is not the original purchaser, or in case of delivery of a gift, then you accept this signature as an evidence of delivery and fulfillment of your order by BeautyScout.

BeautyScout may provide free shipping on all orders above a certain amount from time to time or as stated at Checkout and promotions.

BeautyScout reserves the right to update its shipping policy at its sole discretion without prior notice.

Trademarks and Intellectual Property Rights

The BeautyScout  name and logo, and all related names, design marks, and slogans are the trademarks or service marks of BeautyScout aor our licensors. All software and content (defined as, or includes, any text, audio or music, video, graphics, photographs, and images) are the intellectual property of Divinus Shefa Corp. or our licensors and are protected by intellectual property and copyright laws and international treaty provisions.

This site is for your personal and non-commercial use only. Any non-personal and/or commercial use of the content is only permitted when expressly authorized by Divinus Shefa Corp and/or its third party licensors. You may not distribute, reproduce, publish, sell, or license any software or content contained within the Site without prior written consent or authorization of Divinus Shefa Corp. Any such unauthorized actions may result in civil consequences or criminal penalties.

Divinus Shefa Corp. reserves the right to withdraw or amend any item related to the services without notice. We will not be liable if for any reason the Site is unavailable at any time and for any period.

Return and Refund Policy

Return Eligibility:

1. Item delivered is found to have a manufacturing defect.
   • Not working due to a fault in the product.
2. Item delivered is broken.
   • The item arrived broken and not functioning.
3. Wrong item received (different color, size, or different product).
   • Item received was not the item you ordered.
4. Item delivered has missing parts.
   • Item is missing some parts that cause it not to work as intended.

Exchange Eligibility:

1. Only available for size and/or color of the same item.
2. We will not accommodate exchange requests for a different item.

Some Reminders before submitting a request:

• An Exchange is subject to replacement availability.
• Some items are non-returnable and non-exchangeable:
  • Beauty and Skin care Products
  • Earrings
  • Lingerie
  • Swimwear
  • Note that we do not do refunds but only replace the item. Should the item not be available, we replace with another item of equal or lower cost.

• Please make sure the product is:
  • Within 7 days upon receiving the item
  • Unused original condition
  • Complete with free gifts and accessories
  • Original packaging
  • Tags are intact
  • We may ask for photos of the item (each side)

Indemnity and Waiver

You agree to indemnify, defend, and hold harmless BeautyScout its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages, and/or costs (including, but not limited to, legal fees) arising from your use of this Site or your breach of the Terms of Use.

Complaints

BeautyScout shall perform its obligations under these Terms of Use with reasonable skill and care.

Governing Law

These Terms of Use and your use of the Site (and all non-contractual relationships arising out of or connected to it or them) shall be governed by and construed in accordance with Philippine laws. You submit to the exclusive jurisdiction of Philippine courts to settle any dispute which may arise under these Terms of Use.
